How do you name an association?
如何命名一个组织？
An association must reserve a name with NSW Fair Trading in order to incorporate.
一个组织必须在NSW Fair Trading预定名称以获得法人化
An Application for reservation of name Form A1 must be completed and lodged, with the prescribed fee, at any Fair Trading Centre or by mail to the Registry of Co-operatives & Associations. The application may include three alternative names, in order of preference, for NSW Fair Trading to consider.
必须填写并提交预定名称表格(A1)，指定费用到任何Fair Trading Centre。申请可以包含三个可选名称供NSW Fair Trading考虑。
The first available name will be reserved for three months and will expire if the association does not incorporate in that time.

It is the responsibility of the applicant to check whether a name is restricted in a way that may prevent the use of the name. Applicants should check:

•the National Names Index, on the Australian Securities and Investments Commission website at www.asic.gov.au

Consent may be required, from the appropriate authority, to use certain words or phrases in the name. NSW Fair Trading will contact applicants if further information is required to process the application.

The association will be free to use the name in printing, advertising and signage once registration of incorporation has occurred.

Can a reservation be rejected?

NSW Fair Trading may refuse a name for reservation, if the name:

•is already reserved
•is identical to, or closely resembles, a name that is registered or reserved, and the public is likely to be misled
•contains foreign language characters
•suggests a connection with the Crown or the State
•is considered offensive or undesirable
•is declared by regulation to be unacceptable.
If the proposed or alternative names are rejected, the applicant will be contacted to provide alternatives.

Can we appeal the rejection of a name?

If NSW Fair Trading rejects the proposed name, the association may appeal the decision by applying for an internal administrative review.
如果NSW Fair Trading拒绝提议的名称，组织可一通过申请内部管理复议来上诉。
If the internal administrative review is unsuccessful, the applicant may apply to the Administrative Decisions Tribunal for a further review.

Does the association own the name under which it is incorporated?

Incorporation under a particular name:

•does not give the association the exclusive right to use the name or part of the name
•does not prevent another person from registering a name that includes similar words.

Does incorporation prevent another organisation from undertaking similar activities?
法人化是否组织其他组织从事相似活动？
Incorporation does not prevent another organisation from undertaking similar activities to those undertaken by the incorporated association. Incorporation does not grant an association immunity from an action where it is alleged to be passing off its operations as those of another organisation.
法人化不阻止其他组织从事与法人化组织所从事的类似活动。当其他机构要求停止组织活动时，法人化不授予组织起诉豁免权。

How can an association change its name?
组织如何改名？
To change its name an association must:
改名必须：
•reserve the proposed name by lodging an Application for reservation of name Form A1 with NSW Fair Trading
•pass a special resolution, agreeing to the name change
•lodge an Application for approval for change of name Form A7, including:
◦a copy of the special resolution
◦the original certificate of incorporation
◦the prescribed fee.
An association should be up-to-date with its reporting obligations and this may be checked before the name is registered.

Can an association be directed to change its name?
组织可以被要求改名吗？
An association may be directed to change its name if the name becomes unacceptable. An association can appeal the decision by applying for an internal administrative review.
如果名称变得不可接受，组织可以被要求改名。组织可以向内部管理申请复议。
If the internal administrative review is unsuccessful, the applicant may apply to the Administrative Decisions Tribunal for a further review.

What has to appear on business documents?
哪些内容必须出现在商务文书中？
The full name of the association including the word ‘Incorporated’ or the initials ‘Inc.’ must appear in legible characters on official documents, including all business letters, statements, invoices, receipts, notices and publications (including the associations website).
组织全称加上＂Incorporated＂或者缩写＂Inc．＂必须以清晰的字母形式出现在官方文档中，包括所有的商务信件，申明，发票，收据，通告和出版物(包括组织网站)。
The associations registration number should be quoted in all documentation, correspondence or contact with NSW Fair Trading. The registration number appears on the associations certificate of incorporation and commences with INC or Y.
组织注册号必须在所有与NSW Fair Trading交流或者联系的文档中引用。注册号码以INC或者Y开头显示在组织法人化证书上。
