whether I am a tax resident or non tax resident is always one of hot tax issues evey year. Let us keep it simple. General speaking, if your friend:
(1)has intention to get PR, invest busines, Australian shares and / or rental properties;
(2)stay in OZ over 183 days;
(3)family is in OZ and children are enjoying centerlink benefits;
he should consider himself is a tax resident, who will report chinese income and share trading profit as well.
Hold on! Report chinese income doesn't mean double tax. Your friend can apply paid tax in China as a credit in his Australian individual income tax return.
That is the general ruling. Each case will be different. If your friend doesn't want to report his Chinese income, we can find other ways to solve his issue. |
