车被撞了

事情的经过是这样的：早上6点钟开车出门上班，在家门口的交通灯停下来等绿灯，绿灯出来后，向前开，感觉右手边一个物体
冲过来，躲避已来不及，结果硬邦邦的给撞上了。下车来一看，右前轮已给撞歪了。责备对方闯红灯，中东鬼说他只是闯黄灯。当时天还没亮，没有目击证人。结果警察来录完口供就走了。现在三个礼拜过去了，问AAMI说是还没有确定是谁的责任，没办法处理。我办理的是AAMI 的第三方保险，对方是AAMI 的全保。AAMI 说要是我的责任得付ACCESS FEE $900，还要自己修车。
我一个朋友建议先打电话给中东鬼，说如果不尽快认错就上法庭。可是上法庭又是件劳民伤财的事。要是赢了，还好，要输了真是赔了夫人有折兵。
各位筒子，不知有何建议？

交通条例，当看到黄灯的时候：

57 Stopping for a yellow traffic light or arrow：

(1) ..................................

(2) The driver must stop:

(a) if there is a stop line at or near the traffic lights or arrows and the driver can stop safely before reaching the stop
line — as near as practicable to, but before reaching, the stop line; or

(b) if there is no stop line at or near the traffic lights or arrows and the driver can stop safely before reaching the traffic
lights or arrows — as near as practicable to, but before reaching, the nearest or only traffic lights or arrows; or Part 6 Traffic lights and twin red lights

(c) if the traffic lights or arrows are at an intersection and the driver cannot stop safely in accordance with
paragraph (a) or (b), but can stop safely before entering the intersection — before entering the intersection

(3) If the traffic lights or arrows are at an intersection and the driver is not able to stop safely under subrule (2) and enters the intersection, the driver must leave the intersection as soon as the driver can do so safely.

中东说他只是闯黄灯，闯黄灯而不顾及道路安全已经是违法。只在在第3种情况下，才可以通过黄灯。 要是我的话

在打电话给AAMI， 要他们给你一个ETA，因为他们的Insurance code of conduct 是应该在10天内给你一个答复，i.e.是陪还是不赔

如果大家双方意见一致，不要警察，不然要找警察的。 搂主的问题是要警察的。

最好是手写的字据,有签名的申明之类的.
如果能用手机的录音功能录下对方承认错误的录音也不错.

LZ有加入汽车协会(如南澳的RAA)之类的吗?如果有,可以致电他们的免费法律援助处,他们会给出专业意见,如果他们认为你有理,会帮你先出律师信,再上庭;不过一般只要汽车协会出了律师信,无论保险公司还是个人都知道你的胜诉机会很大,也就会认软了.

我试过一次,AAMI扯皮,我警告他们说已经咨询过RAA的法律意见了,不赔就由RAA告他,结果第二天AAMI的理赔主管就打电话来认软了.汽车协会那几十块钱年费还是很物有所值的.
