ACS的工作经验争论基本尘埃落定--审判还是来了

自从IT职业评估机构ACS从2013年4月份把评估报告“改了个格式”，默默添加了一句后来炒得轰轰烈烈的“after following DDMMYYYY date，申请人才算达到了ACS认可的skilled level”。ACS并在随后的网站更新上继续说明“在此之后可以向移民局提交skilled employment工作经验分数申请”。

一时间，这个所谓的ACS “deeming date” 引起了IT移民界的腥风血雨，众说纷纭。而且ACS在一次答网友问时还很“不小心不专业”的好像小朋友撇清自己没做坏事一样说“这都是DIAC暗中逼我们的，有事找DIAC，555”。




一时间IT申请者们也是有了众生相，有不怕死的说不管ACS的结果还是申请全部工作经验，有哭爹骂娘说ACS出刀太快,DIAC飞暗镖太隐蔽，有淡定的微微一笑说呵呵没啥大不了-我去考个4个7或者4个8就没事了嘛。。。

我们不知道是移民局DIAC懒还是什么原因，其官方网站的更新各方面都是相当滞后不透明的，对于焦点问题“如何定义skilled employment，如何在EOI claim工作经验分数”，DIAC也做过解答，就是只管答一次，而且回答的时刻还是千年不变停留在战国时代2012年11月30日：

建议读者们仔细阅读一下上面的这篇古文，然后和本文后面的最新2013年08月版本条文做对比，你会发现DIAC对于“职业评估机构(by the relevant assessing authority)”的侧重有了前所未有的权重提升。基本上DIAC会完全侧重职业评估机构的评定结果来判定申请人的skilled employment分数获取。



下面隆重介绍通过一些渠道得到的移民局内部指导手册2013年08月最新版本，该手册主要是以移民法为框架出的细则，主要服务于移民局签证官Case Officer(CO)在判定申请人申请分数时候的判定指导和依据。

16 Employment必须是Skilled Level

16.1 人力资本价值模型

所有政策的制定都是以人力资本价值模型原理为基础，从而能够邀请到拥有对口职业丰富劳动工作经验的高专业技能人才到澳大利亚。这样邀请到的高技能人才能够适应高竞争力劳动市场并且为澳大利亚的人口结构合理均衡以及未来经济做出贡献。

高技能的人才能成功融入澳大利亚劳动力市场并为经济做出积极贡献，政策认定Skilled Employment是确保这一切的主要关键要素。



16.2 如何判定工作经验employment何时是skilled

对于能够获得分数的工作经验，必须是满足下面三个要求：

1）工作经验必须是满足对应职业评估机构设定的入门资格以后获得的（也就是说，获取了相应的学位或者一定时间的在职培训后的经验)

2）工作经验必须是符合同等澳大利亚认可的专业度和复杂度下获得的，同时

3）工作经验必须是满足对应职业评估机构设定的skilled employment条件

如果对应的职业评估机构没有评估出skilled employment时间点，而且同时职业评估机构也没有提供对应参考标准的话，此时Case Officer应该考虑申请者提交的获得相应学位后的工作经验并且根据ANZSCO上的要求来协助判定skilled employment.



16.3 申请人什么时候算是skilled

申请人在相应职业评估机构评估报告上给出的skilled date之后是被认为达到了skilled，并且此时申请人可以申请employment工作经验分数：

1）如果申请者的职业评估报告上有给出一个skilled date日期的话,那么Case Officer必须确保申请者提交的任何工作经验分数申请，必须是在那个skilled date日期之后的工作经验，不是之前。

2）申请人达到skilled的日期 可能与职业评估机构认为申请人满足了合格评估要求的日期不相一致。比如，一些职业评估机构可能是基于申请人获得学位之时算是满足了合格评估的要求，但是如果是为了申请skilled employment工作经验分数，那么可能还需要一段学位后的工作经验才能判定申请人是达到了skilled.



看到这里，相信你可能也能想象签证官Case Officer在审判每个申请人工作经验分数的时候，可能就是一边打开着指导手册，一边来判定。所以各位申请人在申请工作经验分数的时候，请务必慎重。

楼主, 我在DIAC的那个CLAIM里没有看到说 "如果DIAC认为的SKILLED 时间与 认证机构有冲突" 相关的议题呢?

这个据称是DIAC内部的工作手册。

如果DIAC认了大家都砍年限，那么今年的配额能用完么？干脆直接把配额砍掉算了，不然到时候那么少不是很难看嘛。。。

我估计快有案例出来了，目前看来全是非公开或非官方的信息，虽然都是指向不利的一面，不过我觉得最终还是要看案例。

其实早期是有案例的，但后来似乎就没有了。。。。所以就算DIAC内部出了这种政策，至少，也没有在6月份开始实施。

I am very very pleased to advise that i have recieved my grant today for 189 visa.

Amidst all the confusion and heart break i have had and the thougths of getting rejected and getting barred from appling for 3 years and all those sleepless nights it was a very painful 1.5 months i must say.

But all is well that ends well isnt it.. I felt that the risk i took paid off and i have my visa granted today. I am so so so happy and cannot express teh happines in words.

Thanks all for all the help, wealth of information and support.i will be able to help anybosy in teh forum with tehir queries except for the ACS vs DIAC skilled assessment points question.

I considered all my experience after a bachelors degree even though ACS said otherwise. May be fortune favors the brave.

However i would not recommend anybody in this forum to take this as a bottomline scenario and go ahead caliming pionts as i did(I was one of teh firsts victim of ACS new rule and nobody knew what to say and hence i had to take the risk). I may just be plain lucky to have got through so please wait have the rules clarified from DIAC and only then apply as now the cost has doubled almost and teh risk as well as i recently heard that ACS has mad these rules public with MARA agent. hence we do not know how it will pan out in the next financial year.

I must apologise to a lot of rorummers here pooja, chetu, chiinu bangalore and a lot more not to have responded to their queries. Amidst these many speculations i made a decision not to check any forums until my case officer either approves or rejects my case. then came my case officer just asking for my medicals and form 80 on 24th May whoch i felt was very soon and i thought she might have not checked my skill assessment letter carefully hence waited again. really sorry guys

My Timelines below::
CO alocation: 24 May (CO : L)
Medicals and form 80 submitted: 01st June
Grant 18th June 2013.

Hi,
I just spoke to diac. They made the following statements
They are not aware of the newly introduced deemed date.
If they feel that the mentioned experience is not relevant from the proof given, only then they will go for the opinion of acs.
Again if I can prove that my experience is relevant, they will consider that.
It is the CO who decides what to consider.
She added that if she was in such a situation she would have gone ahead with the application.

So until now they are not aware of the deemed date, may be that is why they are not updating the same in the website.
But acs replies that they are introducing this because of diac
requested to do so. I mentioned this in the call. She could not comment on that.

按道理7月前提交的eoi适用于上年度政策也说的过去。
7月后提交的不扣估计很难，因为如果有成功案例的话那大家都会不扣提交的。那到时diac又忙不过来了。这不是他们想要的。

不知道有没有澳洲的律师愿意去告DIAC和ACS呢？这个是明显的职业歧视吧，为什么别的职业不减，只有计算机减呢？

我不太懂法律，不过听说澳洲是普通法系，陪审团制度，民告官一般是民赢。而且，集体诉讼的话，应该可以赔不少钱吧？

这样是不是想要配偶加分的去参加acs的评估，也得满足XX date后的 skilled年限才行咯？

这样的话skilled date 就没有标准了，ACS觉得你qualified的日期谁知道是哪一天呢。
