海外驾照可以使用的3个月期限是从签证签发开始算的

Thank you for your email.

Licence holders from another country (other than New Zealand) who come into NSW and hold a permanent visa under the Commonwealth Migration Act 1958 are allowed to drive or ride in NSW on their current overseas licences for a maximum of three months from the date the permanent visa is issued.

If you are a licence holder from New Zealand (regardless if you are a permanent or temporary resident), you must obtain a NSW driver licence within three months of residing in NSW or you must stop driving.

RTA说是这样说，但是实际操作还是不一样的，而且，不同路局的工作人员的说法也不一样。
绝大多数人都是visa grand之后才开始订票计划登陆，99%都超过3个月了才第一次登陆，按这个说法就根本不存在开车的可能了，但是事实上大家都是登陆后买车，开车，利用三个月期间去考路试换本地驾照，从来没有听说哪个路局说过这些新移民都违规了，是无证驾驶。

而且，我看了那个链接，跟你的邮件不一样，

这里根本没提从哪天开始。

这就是我说的不同的路局的工作人员的解释不一样，有的说从第一次登陆开始；有些说从这次登陆开始；还有就是你这个，我倒是第一次听到，说从visa那天开始，这个完全不合理，从visa签发那天开始，根本不存在开车可能了。

我也觉得这个规定不合理。。。但既然官方这么说，还是小心为好。。
听说有人被查到，罚了900$。。

还有呢： you intend to stay in NSW, you are not considered to be a visitor. As such, you are allowed to drive in NSW on a current overseas licence for a maximum of three months. 如果visa签发了，我不打算intend to stay in NSW呢？例如我想去布里斯班，或者去墨尔本，所以，可以理解为短登都不算，而是从你打算长登NSW才算你intend to stay in NSW，从这时候才开始算三个月。

你换个时间再发个邮件去问，说不定又有个不同解释给你了呢。

唯一的可能就是你在三个月之内登陆。。非常不方便。。反正我现在是不敢开，还是拿到驾照再开吧。。至少考过理论考试。。

绝对没问题，就算上庭你也不会被罚，网页上写得清清楚楚：If you’re a permanent Australian resident, or hold a permanent visa under the Commonwealth Migration Act 1958, and you intend to stay in NSW。 这里用的是And，是充分条件。例如你短登过墨尔本，短登过布里斯班，都不算and you intend to stay in NSW。

在维州，Vicroads上关于海外驾照的时间表述是：

If you have entered Victoria on a permanent visa issued under the Migration Act 1958 you may drive on your overseas driver licence, providing it is written in English or accompanied by an English translation or international driving permit for:
•6 months from the date you first entered Australia if the permanent visa was issued before you entered Australia, or
•6 months from the date when the permanent visa was issued to you if the permanent visa was issued to you while in Australia.

签证签发时，offshore的以first enter那天起算，onshore的以签发日起算。

我觉得楼上的这个比较权威和合理，对新州的应该也有参考价值。

ps：现在中国护照持香港驾照的，好像在新州已经不能直接换full了。可惜。

伊宁说的很对，不同的RTA给的说法是不一样的。我自己刚长登的时候打算三个月内考Full牌，但是在central哪个RTA考完DKT非要我拿L牌，说短登过这次登录就没有三个月可以用海外驾照了。而一朋友当初也短登过的，去年长登在Katoomba考了DKT想拿L牌多练练车，对方死活不给，说海外驾照还可以开三个月不用拿L牌。。。

楼上的至少验证了一个问题：短登是可以使用3个月海外驾照的。

其实谁的解释都没有警察的解释有意义，因为直接拦你的是警察，他们认为你违法了才会处罚你。
哥就被拦过，警察的解释就是你在本地以永久居民身份居住的那一天开始算。短登了1周，又走了，也顶多减去一周，或者就直接忽略。
当然，每个警察的领会不一致，但一般来说，警察不会没事查你的签证，也就是说他们即使看了你的翻译驾照，也不会直接联想到你的身份只允许你在这种条件下开三个月的车。
所以，如果没来得及换驾照的朋友们，也没必要太恐惧这有限的三个月。
但从长远来说，换本地驾照是必须的，大家还是认真学习交规，安全开好车。

对的，所以要尽快考个full 出来。说实话，没有经过笔试，没有教练指导过，直接上路感觉很容易出意外。

其实没有什么明确的规定，即使有，解释和执行也是五花八门。命是你自己的，而且只有一条，要某个部门制定规则来令你珍爱自己的生命，显得有点多此一举，也有点搞笑。所以，持海外驾照的，在你通过路考之前，最好少碰车。
