What is a postal ballot?

If the constitution permits, a postal ballot is a convenient method for voting on a resolution, where members are geographically dispersed or have difficulty attending a meeting.

A postal ballot can determine a resolution, permitted by the constitution.

The committee is required to:

•set out the details of the ballot proposal in a statement, including if it is a special resolution
•set a delivery date for ballot papers

The returning officer conducts the ballot on behalf of the association.

They complete the following tasks:

•prepare a roll setting out members eligible to vote, including names and addresses
•ensure the ballot papers are prepared in accordance with Form A in the Regulation as determined by the committee
•ensure the ballot papers are initialled by the returning officer or assistant, or bear a mark identifying them as official
•ensures the following documents are sent to members at least 14 days (or 21 days for a special resolution) before the closing date:
◦one ballot paper
◦an envelope (the outer envelope) addressed to the returning officer and noted or printed with the members name and address on the reverse side
◦a small envelope (the inner envelope)
◦a copy of the ballot proposal statement
•ensures the ballot papers are kept safe upon return
•counts the ballot papers
•provides a statement setting out the results of the ballot
•retains the rolls, ballot papers and rejected outer envelopes for a minimum period of eight weeks.

What if the ballot paper is lost, damaged or not received?

If the returning officer is satisfied that the ballot paper was lost, spoilt, damaged or not received and the member has not voted; they may issue a duplicate ballot paper.

The duplicate ballot paper must be marked with the word 'duplicate'.

How does a member vote?

Once the member has received the information concerning the ballot, they will follow these steps:

•mark their vote on the ballot paper, according to instructions
•place the ballot paper in the inner envelope and seal
•place the inner envelope in the outer envelope and seal
•note their name and address on the reverse side of the outer envelope, if not already provided
•return the outer envelope by post or in person to the returning officer.

How are the votes counted?

As the outer envelopes are received, they are placed in a secure ballot box, no later than the closing date.

The returning officer will:

•open the ballot box in the presence of scrutineers, if appointed by the committee
•examine the outer envelopes and mark the members name on the voting roll with a line through the name
•remove the inner envelope

The returning officer will examine and count the formal votes and prepare a signed statement setting:

•the proportion of formal votes in favour of the proposal.

When will a ballot paper be rejected?

A ballot paper will be rejected if a duplicate ballot paper had been issued and the original paper has been received.

When will a ballot paper be rejected as informal?

A ballot paper will be rejected as informal if:

What happens to the returned ballot papers?

The returning officer will retain the roll, ballot papers and rejected outer envelopes once counting has finished.

The returning officer will place the documents in a secure ballot box for a minimum period of eight weeks. The committee may direct a longer period.

When will a resolution pass?

An ordinary resolution requires a simple majority of formal votes, 50% plus 1.

A special resolution requires at least 75% support of formal votes.
