1. 在要求客户签字之前,必须声明自己所取得的佣金内容细节以及数额。
2. 如果经纪人本身就是金融机构代表,同时又宣称自己是贷款经纪人,如果像顾客特别推荐自己机构的产品,必须有合理根据,不能有偏见。
3. 参加相关培训并通过相关协会的认证,比如说(MFAA)等。在客户要求下,需出示相关证书。
4. 有自己的职业赔偿保险。
5. 向客户提供建议时,有合理的逻辑推理,要清晰解释比较不同贷款的方法,以及如何得出结论。
6. 向客户介绍自己所代表的所有放贷机构,不可以宣称“可以找到最好的产品”,在不能代表所有金融机构的情况下。
7. 向客户表明在整个还款期间内,所提供的服务内容。
8. 向客户提供所有贷款产品的数据包括"真实利率",或"年平均利率"。
9. 如果建议客户转移已有的贷款到新的机构,必须详细解释理由以及给客户带来的好处,避免只为私利,挣取佣金; 在建议转移之前,原放贷机构须被验证是否可以提供更优惠的产品。
10. 必须明确宣告所有费用,在提供服务之前。包括自己的收费,和放贷机构的收费。


(真实利率)(年平均利率), 通常也被称作Comparison Rate, 市政府监管机构要求贷款机构必须出示的利率,有统一的计算方法,便于消费者透过广告利率(很多种不同计算方法),比较不同机构贷款产品的真实利率。


Mortgage brokers (lender's agents) should be required to:
1. Declare commissions upfront to the client before anything is signed. Any other special incentives for brokers to refer clients to a particular lender should also be declared upfront.
2. Let the client know immediately if they are a lender as well as a broker. If they are marketing themselves as a broker, no preference should be given to their own products. A clear rationale should be provided if they end up pointing the client towards their own loan products.
3. Undertake training in lending and receive a satisfactory pass with a reputable organisation such as the Mortgage & Finance Association of Australia or the Securities Institute of Australia. Credentials should be provided to all clients upon request.
4.Have their own professional indemnity insurance. Mortgage brokers (lenders' agents) should not automatically assume that they are covered by the indemnity of an umbrella organisation but check to ensure their own operations are covered.
5.Provide clients with a clear methodology and explanation about how they compared loans and arrived at particular loan recommendations.
6.Inform clients about the make-up of their lending panels and not misrepresent their ability
to provide clients with 'the best loan' when they don't have all lenders' loans on their books.
7.Inform clients about what sort of ongoing service they will receive over the life of their loans.
8.Declare the 'true' interest rate or 'Annualised Average Percentage Rate' of all recommended loans.
9. Only refinance a client's loan when there are clear and explainable benefits for the client - avoiding the practice of 'churning loans' in order to earn extra commissions. The client's existing lender should also be approached first to see if a better deal can be provided.
10.Declare all fees upfront to their clients - both their own fees and the lender's.

Note:'True interest rate' and 'Annualised Average Percentage Rate" New legislation effective 1 July 2003, will require lenders to display the Comparison Rate in advertisements. The advertised Comparison Rate will be calculated based on an average loan amount and loan term that is relevant to the product.
