Road traffic accidents involving pedestrians are more complicated if the pedestrian has not crossed at a designated pedestrian crossing. In these cases your chance of claiming compensation would depend on who is at fault for the accident. If you are a pedestrian that has stepped out into the road without looking and have been immediately hit by a car or other vehicle, you may still be able to seek compensation.
Road vehicle users owe a duty of care to pedestrians. The courts put a very high duty on a road user to a pedestrian even when they may not be fully aware of the situation.
Pedestrians are of course particularly vulnerable, may not always be paying attention to cars and other vehicles, may not always be sober, or may be children whose visual and spatial awareness is not as developed as that of an adult. The courts generally rule that in a car accident with a pedestrian, drivers are expected to take all these factors into account and show a duty of care to the pedestrian, and the driver may be found liable in most of these situations.
For example, a drunk pedestrian who was knocked down after leaving a nightclub or pub could still claim compensation for injuries.
If an accident happens, wherever possible always keep a record and take photographs if you can; take the names and home addresses of witnesses; keep evidence of doctors visited and treatments, and keep receipts for any injury related expenses.
