标题: 路边停车纠纷
我在路上行驶，左前方有个空位，前面的货车打灯提示想要停车。我停下来，但可能空档留的不够大，他在后退泊车时蹭到了我的车。后面的车已排成长龙，我已无法后退。他们的保险公司找到了我的保险公司，说是我的错，让我画图。车拉到修理厂后，电脑开始显示是对方的错，后来又说未定。我有错吗？

如果你车子已经停车(没有继续向前移动)，对方仍然倒车而撞到你，那么就是对方没有足够观察到周围状况保证安全才能倒车，他有过错。至于你有没有过错，要看当时具体情况。
如果你俩都在移动中产生碰撞，对方在Park 车，而你继续向前开，通常判断是park车者无过错。

还好对方撞的是车子，没伤害到人。。。

我肯定是停车了，看到他快要撞到时想往后退，但后面已经排队了，退不了了。然后车上下来2个中东人，骂我傻。

被恶人先告状了？碰到这种事应该拍照，然后主动打电话给保险公司说明情况，尤其是对方还态度恶劣，更加应该及时走正式流程，恶人就应该交给保险公司去和他们磨去。如果LZ当时的车子是停着的话，肯定是对方的错。倒车空间不够的话就应该重新起步找别的车位，有啥资格自倒进去还骂你傻的？还有你看他倒车要撞到你，也不能随便退，一退就可能自己出车祸，而且说不清楚了。

44 Keeping a safe distance when overtaking
A driver overtaking a vehicle —
(a) must pass the vehicle at a sufficient distance to avoid a collision with the vehicle or obstructing the path of the vehicle; and
(b) must not return to the marked lane or line of traffic where the vehicle is travelling until the driver is a sufficient distance past the vehicle to avoid a collision with the vehicle or obstructing the path of the vehicle.

There is also this rule
126 Keeping a safe distance behind vehicles
A driver must drive a sufficient distance behind a vehicle travelling in front of the driver so the driver can, if necessary, stop safely to avoid a collision with the vehicle.

Although the reversing rule does also apply in your case, the other driver can still be at fault.

How to parallel park

Parallel parking is one of the most challenging parking maneuvers. If you haven't already, learn the basic parking skills before learning to parallel park.

Getting started

If you are worried about bumping into another car, start off on a street or in a car park where it's safe and there is little or no traffic around. You're not likely to have a serious crash while parking but small crashes can be expensive. Don't try your first parallel park in a busy street.

Practice parallel parking

Check your mirrors.
Before you intend to park, check the rear and near side mirrors for traffic behind. If you have vehicles following you closely and will not be able to slow down smoothly and safely, keep going and choose another place to park.

Use your indicators.
Give other road users plenty of warning that you are going to park by indicating early.

Slow down.
Brake gently and slow down gradually. Check that the drivers behind you are responding.

Be observant.
As you approach the vehicle you are parking behind, notice its size and how far out from the kerb it is. Later, this information will be useful.

Prepare to park.
Come almost to a stop along side the space you intend to park. (This forces any drivers behind you to hang back and gives you room to reverse.) Ease off the brakes and move slowly forward alongside the car you are going to park behind – keep a good arm's length out. Stop when the rears of both cars are level.

Reverse into the parking spot.
Select reverse gear. Look back over your shoulder into the parking space and keep looking back. Reverse slowly until you judge your back wheel is getting near the rear of the car next to you. (Your back wheel is what's called a ‘pivot point’ - the point your car pivots around as you steer.)

谢谢大家的分析，说一句实在的，在交换驾照后我看那个司机是个中东人的名字，而且姓和名字居然都是一样的，长的也挺凶。真有点怕，如果判他们错，他们有我的信息，真的担心自己的安全了

倒车者必须要留意到后车，如果发生意外，倒车全责。

我理解你的担心，这种担心我以前也有。
我觉的99%不会，没那个必要为了几百块钱恐吓你，甚至人身伤害
但是如果你很担心，小心点也是必要

比如，回家晚的话，左看看右看看，先把钥匙拿手里，车子锁好
如果楼下有防盗门最好，没有么你住HOUSE的话，可以留意一下或者跟邻居搞好关系，帮着留意一下

我是介么理解，中国人在自己的国家从来不踏马的讲法律，来到西方一根筋的讲法律，我都踏马的无语啦

西方相对宜居，很多时候靠的common sense的吧

这种杂事，天天开车经常会遇到，无论驾驶者是什么性别和肤色，正确方式就是多学交规，按章做事；自己对了就要坚持，自己错了就要承认，没什么大不了的。

倒车的全责

缺少细节不太好判断责任，比如当前车已经打灯提醒后车其准备停车后，后车是否仍然在往前行驶？如此致前车靠边停车时空间不够，个人认为后车也有部分责任，但不会是全责，因为前车应该随时观察后面的距离是否足够，不能闭着眼睛倒车不是。

对的，如果情况正如楼主所说，楼主停车了，而对方依然在前面parking, 那么就是倒车者责任。
如果是两个人都在移动中碰撞，那么则是楼主责任。

你打黑体的这句话说明，即使后车移动，只要前车继续倒，撞到了就是前车的全责。

所以，两辆车都在动，产生的碰撞责任，要看具体场景，结合整个过程来判定 -- 依照过失大小来判断谁负主要责任，如果是各执一词，没有目击证人，那么常见的是各打50大板。

你好。我觉得你这个用overtaking或者safe distance的解释不是很适用，一般来说倒车reverse 要承担注意安全的责任而不是后车。

后车保持车距这个情况，通常都是前车静止或者正常行驶的情况。而且lz当时并没有行驶而是静止状态。总不能说你开过了，然后你要倒车，后面的必须给你让吧。都是先打提示灯减速，提前提醒后面车辆留出倒车空间。

如果是法规上来说
AUSTRALIAN ROAD RULES - REG 296

296—Driving a vehicle in reverse

(1) The driver of a vehicle must not reverse the vehicle unless the driver can do so safely.

Offence provision.

(2) The driver of a vehicle must not reverse the vehicle further than is reasonable in the circumstances.

Offence provision.

不要激动，哥们。

倒车的时候和别的车相撞，100%是倒车人的责任，无论什么情况，发现有可能的危险，要停止倒车。

之所以这么说。我一朋友之前出去玩，从停车位倒车出来撞到警车了侧前方（擦到了一下），警车也是让了一下要overtake，但是朋友没看到倒的快了点，

，运气差，不过也不需要证人啥的了，警察替我朋友填了所有的表格，她叫了excess fee 修了车，认了错

不管是倒车进停车位，还是倒车出停车位，还是其他原因倒车，倒车人都要确保安全。

事故发生时辆车都在行进中，一个前进，一个倒车，倒车的就要对这个事故负责的呀

安全第一，有时候法律本身就是bullshit

，自己多注意点，减少危险

lz这个既然lz都停下来了，肯定是前面倒车的责任，但是要找好证据，要不然够头疼的。

肯定是前面的车负全责，不够位置就必须继续前行或再掉头回来，不能在不安全的情况下强行倒退停车。

说到这个~我前两天干了件很蠢的事情~~~是酱紫的~我原本开的很好的~忽然被block在了路中间~原本也没什么~但是我让了几辆右转车之后~灯变红了~然后我就在马路中间~然后~我居然脑子抽住~觉得自己在马路中间block住了人家~就过去了~过去了~才意识到md~红灯阿~红灯也没什么~md路口有摄像头阿~我真是自己给自己找麻烦~~~

你是红灯之后又越过停车线的？那恐怕要罚款了，安慰安慰。但如果在黄灯时已经完全越过停车线，红灯时再通过路口，应该是不罚款的吧？

你是直行，但是由于太堵导致你过了停车线停下来了？是你的错，但是理论上红灯应该不会拍你的，如果你红灯之前出来的足够远了。应该已经过了触发点了
