The next thing I'd like to bring up for discussion is packing. We'd like to hear what you say concerning the matter of packing.下面我想提出包装问题讨论一下。我很想听听你们就包装问题发表意见。

Your opinions on packing will be passed on to our manufacturers.

索赔是国际贸易中重要的一项，当然不被索赔最好，但有时由于各种原因，索赔也在所难免。对于刚刚开始接触国际贸易的人来说，商务信函应该用的语气和句式都把握不太好。
这次就给大家提供一些索赔和投诉信中常常用到的表达，希望可以给大家一点启发。
I am writing for a replacement of the dictionary included.
特函要求替换随信寄去的字典。
Would you please correct your shipment by sending the order No. 2530 by the first available vessel?
请把我方2530号订单项下的货物装第一艘可订到仓位的货船运来，以纠正你方发货错误。
It would be highly appreciated if you could look into the personal computers, which should have reached our destination two weeks ago.

There are some different types of claims.
索赔有几种不同的类型。
This is a claim on quality.
这是质量索赔。
This is a claim on shortweight.
这是短重索赔。
This is a claim on delayed shipment.
这是延期装运索赔。
Claim on shortweight is caused by packing damage or shortloading.
短重索赔是由包装破损或装运短重引起的。
Claim on delayed shipment is that sellers fail to make the delivery according to time schedule.
延期索赔是对卖方没有按时装运货物而提出的索赔。
Claim on quality originates from inferior quality of goods or quality changes.
品质（质量）索赔是在货物质量低劣或是质量改变的条件下发生的。
拒绝索赔有很多种原因，我们来看看一些常见原因的表达。
1. On going into the matter you mentioned we find that the poor performance of the engine is due to your incorrect use of a different motor oil.
我们对你方提到的事情调查后发现，发动机故障是因为你们误用了不同的机油。
2. Items like this are not to be returned once they are accepted by purchasers. We have established this regulation for offering our customers the definite best quality products.
此类商品一旦售出就不能退换。我们立此规定是为了向顾客提供绝对上等的产品。
3. This is exactly the first complaint from our customers, from which we can understand you have met much inconvenience in satisfying your users.
这确实是我们收到的第一封索赔信，我们可以理解您在满足用户需求方面的许多不便。
4. All the items for export must be under the tight seal which ensures that we always put the Total Quality Control into execution.
所有出口品种都必须真空密封，以保证全面控制质量这一措施的实行。
5. Our investigation reveals that the articles we packed were identical with what were listed on our invoice. We are afraid that the cases you mentioned must have been unpacked during the transit. We are enclosing a copy of the invoice for your reference and suggest you make further inquiries at your end.
我方调查结果表明：我们打包的东西和发票上的一致。恐怕你说的那些箱子在运输过程中被人打开过。随函寄去一份发票复印件，建议你方进一步调查。
6. We are extremely sorry for the late delivery of your last order. It is due to your delayed opening of the relative letter of credit.
非常抱歉上一批货交晚了。因为你们的信用证开得太迟。
7. As stipulated in the contract, a minor discrepancy in colors is permissible. That is why the case you brought up is still under a normal practice.
如合同所示，颜色上的轻微差异是允许的。故此，你提出的情况依然属于正常做法。
生意不可能总是一帆风顺，不管企业多么细心、精心地处理业务往来，事故还是难以避免：货物可能送错了地方，可能在运输中受损或者延迟，等等，各种情况都可能发生。
当发生事故的时候，如果只是一些很快就能得到解决的小问题（比如保险、保证或是其他合同条款），一封日常投诉信就完全可以了。
由于这些小问题一般不会遭到对方的反对，日常投诉信只要清楚、明了、简要就行。下面是写日常投诉信所遵循的法则：
1. 开头就提出要求。
2. 详细解释此要求的原因。
3. 结尾要表示感谢对方的合作。
下面是一封日常投诉信的范例，请大家体会一下。
Dear Sir/Madam,
Please send us a correction on part of our order WP-11.
All the items we ordered arrived in excellent condition except for one model. It you refer to our original order (see the copy attached), you will note that we requested your fluorescent desk-lamps, Model 606. However, Model 608 reached us instead. For details, please see the inspection certificate issued by the Tianjin Commodity Inspection Bureau.
Will you kindly take back those you sent out and substitute them with an equal quantity (120 items) of Model 606? We would appreciate your attention to this matter promptly.

There is an arbitration clause in the contract (or insurance clause, inspection clause, shipping clause, etc) .这是合同中的一项仲裁条款(或：保险条款，检验条款，装运条款等)。

例1：双方同意以装运港中国进出口商品检验局签发的品质及数量检验证书为最后依据对双方具有约束力。
It is mutually agreed that the goods are subject to the Inspection Certificate of Quality and Inspection Certificate of Quantity issued by China Import and Export at the port of shipment. The Certificate shall be binding on both parties.
例2：在交货前制造商应就订货的质量、规格、数量、性能做出准确全面的检验，并出具货物与本合同相符的检验证书。该证书为议付货款时向银行提交单据的一部分，但不得作为货物质量、规格、数量、性能的最后依据，制造商应将记载检验细节的书面报告附在品质检验书内。
Before delivery the manufacturer should make a precise and overall inspection of the goods regarding quality, quantity, specification and performance and issue the certificate indicating the goods in conformity with the stipulation of the contract. The certificates are one part of the documents presented to the bank for negotiation of the payment and should not be considered as final regarding quality, quantity, specification and performance. The manufacturer should include the inspection written report in the Inspection Certificate of Quality, stating the inspection particulars.
2）索赔条款。
包括索赔权的规定、索赔时间、索赔依据和赔付方法。
例1：买方对于装运货物的任何异议必须与装运货物的船只到达目的港后30天内提出，并须提供经卖方同意的公正机关出具的检验报告，如果货物已经加工，买方即丧失索赔权利。属于保险公司或轮船公司责任范围的索赔，卖方不予受理。
Any discrepancy on the shipped goods should be put forward within 30 days after the arrival of the vessel carrying the goods at the port of destination and the Buyer should present the Survey Report issued by the Surveyor agreed by the Seller. If the goods have been processed the Buyer will loss the right to claim. The Seller shall not settle the claim within the responsibility of the Insurance Company or Ship Company.
例2：品质异议须于货物到达目的港30天内提出，数量异议须于货物到达目的港15天提出，但均须提供相关检验机构的证明，如属卖方责任，卖方应予以收到异议20天内答复，并提出处理意见。
Any discrepancy about quality should be presented within 30 days after the arrival of the goods at the port of destination; any discrepancy about quantity should be presented within 15 days after the arrival of the goods at the port of destination, both of which cases should be on the strength of the certificates issued by the related surveyor. If the Seller is liable he should send the reply together with the proposal for settlement within 20 days after receiving the said discrepancy.

英语中的一词多义常常让人一头雾水，商务英语中更是如此。

1. confirm
例一：
We'd like to inform you that our counter sample will be sent to you by DHL by the end of this week. Please confirm it ASAP so that we can start mass production.
很高兴通知您，我们的回样将于本周末用特快专递给您。请尽快确认，以便我们开始大批生产。
例二：
Payment will be made by a 100% confirmed, irrevocable Letter of Credit, available by sight draft。
付款方式为 100% 即期，保兑，不可撤消信用证。
注解：在第一个句子中，confirm 的意思是"确认"。在第二个句子中，confirmed L/C 应翻译为"保兑信用证"，即指一家银行所开的由另一家银行保证兑付的一种银行信用证。
2. negotiable
例一：
Part-time barman required. Hours and pay negotiable.
招聘兼职酒吧侍者，工作时间和薪水面议。
例二：
This Bill of Lading is issued in negotiable form, so it shall constitute title to the goods and the holder, by endorsement of this B/L.
所签发的提单为可转让的。故只要在提单上背书，便确定了货物和持票人的所有权。
注解：在第一句话中，negotiable 的意思是"可商议的"；在第二句话中的意思则是可转让的"。"可转让提单" 经过背书后即可将所有权转让给他人。值得注意的是，negotiating bank 则是议付银行，即购买或贴现汇票的银行。
3. endorse
例一：
Our products have been endorsed by the National Quality Inspection Association.
我们的产品为全国质量检查协会推荐产品。
例二：
Drafts must be accompanied by full set original on board marine bill of lading made to order，endorsed in blank, marked right, prepaid.
汇票必须附有全套印有"货物收讫"字样的正本海运提单，凭指示、空白背书，并写明"运费已付"。
注解： 在第一个句子中，endorse指用过某种产品后感到满意，并通过媒体介绍给公众。而第二句中的endorsed in blank是指背书人endorser 只在票据背面签上自己的名字，而不注明特定的被背书人(endorsee)。
4. average
例一：
If a particular cargo is partially damaged, the damage is called particular average.
如果某批货是部分受损我们称之为"单独海损"。
例二：
It's obvious that the products are below average quality.
很明显，这批产品的品质是中下水平。
注解：在第一个句子中，particular average 意思是"单独海损"，是指在保险业中由于海上事故所导致的部分损失。第二个句子中average是指"平均的"。
5. tender
例一：
Under the CIF, it is the seller's obligation to tender the relative documents to the buyer to enable him to deliver the goods.
在 CIF 价格术语项下的责任是向买方递交有关单证，使其能在货物到达后提取货物。
例二：
He became as happy as if his tender for building a mansion had been accepted.
他欣喜若狂，好象他承办大厦筑的投标被接受了。
注解： 商务英语中的重要条款用词非常正规，第一句话中，tender 是用作动词，相当于 give。而在第二句中，tender 是用作名词，意思是"投标"。

海运进口代理流程
海运进口代理流程为签订代理进口协议→收货人预备进口单据→换单→报检→报关→办理货物交接单→提箱→提货具体操作：首先，与外贸公司签订进口代理协议
一、进口单据
1、收货人向货代提供进口全套单据；货代查清此货物由哪家船公司承运、哪家船代操作、在哪里可以换取提货单（小提单）。
2、进口单据包括：带背书的正本提单或电放副本、装箱单、发票、合同（一般贸易）。
3、货代提前联系场站并确认好提箱费、掏箱费、装车费、回空费。
二、换单
1、货代在指定船代或船公司确认该船到港时间、地点，如需转船，必须确认二程船名。
2、凭带背书的正本提单（如果电报放货，可带电报放货的传真件与保函）去船公司或船代换取提货单（小提单）。
注：“背书正本提单”两种形式：
（1）提单上收货人栏显示“订舱人”，则由发货人背书；
（2）提单上收货人栏显示真正的收货人，则需收货人背书。
三、报检
检验检疫局根据“商品编码”中的监管条件，确认此票货是否要做商检。
四、报关（清关）
1、外贸公司负责清关
2、报关资料包括：带背书正本提单/电放副本、装箱单、发票、合同、小提单
3、海关：
（1）通关时间：一个工作日以内
（2）特殊货物：二到三个工作日
（3）查验：a，技术查验：依据单据以及具体货物决定是否查验；b：随机查验：海关放行科放行后，电脑自行抽查。
五、办理货物交接单
1、货代凭带背书的正本提单（电放放货的传真件和保函）去船公司或船代的箱管部办理货物交接单。
2、货物交接单：它是集装箱进出港区、场站时，回箱人、运箱人与箱管人或其代理之间交换集装箱及其他机械设备的凭证，并有管箱人发放集装箱凭证的功能。它分进场和出场两种，交换手续均在码头堆场大门口办理。
注：拼箱货（CFS条款交货），凭船代业务部进口科的通知单到箱管部交纳进口单证费，然后可凭“小提单”和分单到码头直接提取货物，无须办理设备交接单。
六、提箱
1、货代凭小提单和拖车公司的“提箱申请书”到箱管部办理进口集装箱超期使用费、卸箱费、进口单证费等费用的押款手续。
2、若押款人不是提单上所注明的收货人，押款人必须出具同意为收货人押款并支付相应费用的保证函（保函）。
3、押款完毕经船代箱管部授权后到进口放箱岗办理提箱手续，领取集装箱设备交接单，并核对其内容是否正确。
4、收货人拆空进口货物后，将空箱返回指定的回箱地点。
5、空箱返回指定堆场后，收货人要及时凭押款凭证，到箱管部办理集装箱费用的结算手续。
七、提货
1、货代或收货人凭小提单，联系拖车去船代指定的码头、场站提取货物。
2、押款人到箱管部办理集装箱押款结算手续。
注：拼箱货需要到船公司或船代理签取散货分提单（分单），提货时用小提单和分单到码头提取货物。
八、费用及其他
针对不同的情况，按照商议的价格计算！
海关、商检工作时间：09：00―11：30 13：30―17：30
报关行：08：30―12：00 13：00―18：00
节假日休息。进口一定要查验货物。
正常情况下进口可在码头免费存放七天。
