Thank you for your email of XX Oct. 2008 to the Minister for Immigration and
Citizenship, Senator Chris Evans, concerning your application for skilled migration.
The Minister has asked me to reply on his behalf.
In your email you write that applications lodged with the Adelaide Skilled Processing
Centre (ASPC) are not being processed in date order and you also question the
delay in processing times. I acknowledge your frustration on this matter and regret
any inconvenience caused.
The ASPC endeavours to process all complete applications in order of receipt and
this policy is followed carefully wherever possible. The legislation allows the order of
processing to be influenced by variations in workload, the particular circumstances of
cases and policy priorities. In practice there are a number of factors, including
legislative requirements and Ministerial Directions, which have a bearing on
allocation to case officers and subsequent processing. For example, under
Ministerial Direction, applications are to be processed in the following order:
• applications relating to the entry of a person whose occupation is listed on the
Migration Occupations in Demand List (MODL);
• applications for State-specific and regional migration visa sub classes; and
• all other fully completed applications in the order in which they are received.
In addition to this, the ASPC has nine separate processing areas, each responsible
for different visa categories. Because of this and because of the large volume of
applications received, allocation dates for applications from one processing area
sometimes fall out of alignment with others.
Other factors that have recently influenced the processing order include changes that
were made to the General Skilled Migration Program on 1 September 2007. These
changes included the introduction of nine new subclasses of visas and the facility to
lodge applications electronically. The post 1 September 2007 Regulations are
significantly different from the earlier Regulations. To ensure that the systems and
legislative settings are working correctly the ASPC began processing these
applications soon after 1 September 2007. The introduction of electronic lodgement
for the new subclasses has meant that these applications are able to be processed
more quickly than paper-based applications. The majority of the ASPC staff
continues to process applications lodged before September 2007.
The Department is committed to providing a high level of client service. We welcome
your feedback as an important means of identifying areas where we may be falling
short of our service standards. While it is regrettable that the Department’s service
has not met your expectations, the matters you have raised will assist us to identify
ways to improve our service to clients in the future. I hope that this letter has helped
to clarify your concerns.
