[经历分享] 房屋agent 要签字,大家看看,帮给支支招吧

发现了曾经有白蚁的痕迹,白蚁检查的人建议向房主要以前的检查报告,我们去要, 房屋agent一拖再拖,最后实在拖不下了,就发给了我们。

看了报告发现白蚁以前还是挺严重的, 以前的报告是:2012年底附近发现了两个蚁巢,并着手处理, 2013年底再次检查这两个蚁巢基本除去了,但不能肯定以后的

基于这种情况,不想马上签白蚁检查过关的字, agent 就发这样的信件来了

这算不算威胁呢

The damage to the picket fence is of a very small and minor nature.

The area of old white ant workings in confined to only a few pickets in the fence
Almost without exception in the sale of similar villas or houses in the Perth Metropolitan Region, there would be similar old white ant workings of this nature. In a sale of a property in similar circumstances there would be no impediment to the fulfilment of contractual requirements. The buyers of those other properties would readily accept such a report and sign a waiver.  

Issue of prior knowledge - Ro**en Real Estate had no knowledge whatsoever of the damage to part of the southern picket fences.

The seller is an extremely elderly woman and it is very unlikely that she would have any awareness of the old white ant workings.

The first time that I became aware of the old white ant workings was when both met with Houspect and he brought it to your and my attention.
There is no evidence of current white ant infestation and the inconsequential damage has in all probability existed for many years.

You decided not to provide us with a copy of either the building or white ant inspector’s reports. This is very unusual and in all the years of professional practice by the Principals and staff of our company, it has never happened before.

It is normal for white ant inspectors to refer to virtually any old termite working as being ‘moderate damage’. Indeed, it would be highly unusual for such a report to use a lower category impairment description.

The location of the old white ant workings are in an area that are largely covered by green foliage and are not readily visible.

The minor cost of the replacement of a few pickets will be the responsibility of the Body Corporate.

There is absolutely no disadvantage to you.

In British Common Law, to establish a damage (or what is known as a ‘tort’) your loss would need to be shown. This cannot be so established as there is none.
As there is no loss or damage it is most sincere recommendation that you both sign the waiver and provide it to us today.

这个是要签字的,曾经有白蚁的痕迹不能作为拖延的原因。在澳洲有曾经有白蚁的痕迹也是比较正常的现象。

问题是 agent 写这个来,
不确定那些是恫吓,那些是正常的,
所以请坛友支招!

那房子地上没有termite barrier?院子里没有termite bait?Damaged fence全换走了?这些连我都懂,不可能逃过中介的眼睛。

从来没看到有人在书面语里把termite写成white ant,也没有看到有人用british common law威胁别人。british common law是federal law,state law还是by law?凡是牵涉body corporate的地方,公共区域的fence它会负责,自己家里的fence是对半开,前提是body corporate chair person同意为另一半买单。

中介的意思很明显,赶快签字吧,commission到手了,以后的事情就不管了。退房子也是有技巧的。想退还是不想退,楼主自己决定吧。
