Hi, Generally, ATO will consider you to be an Australian resident for tax purposes if you
1. have always lived in Australia or you have come to Australia to live
2. have been in Australia for more than half of the income year and for most of the time you have been in the one job and living in the same place,(unless your usual home is overseas and you do not intend to live in Australia – for example, you are a working holiday maker), or
3. are an overseas student enrolled in a course of study for more than six months duration.
In your case, it depends on whether you have any interest from Australia before Jan 2011, i.e. investment property. If answere is yes, ATO might consider you are Australian resident for whole year. Otherwise, ATO might consider all of you are Australian resident from Jan 2011. Because your wife and baby will live in Australia, it is possible that you will be deemed as resident for tax purpose.
Please make it clear if you are part year resident, it doesn't mean you must to lodge tax return. there is a online test from ATO website for your reference.
